[1] This is an Application filed on October 22, 2012 under section 34 of Part IV of the Human Rights Code, R.S.O. 1990, c. H.19, as amended (the “Code”) alleging discrimination with respect to employment on the basis of race, colour, ancestry, place of origin, citizenship, ethnic origin, sex and marital status.
[2] The applicant worked for the respondent farm as a mushroom harvester under a temporary foreign worker program. The applicant resided in an apartment with other workers as arranged by the respondent employer. The respondent imposed a house rule against having overnight guests of the opposite sex. The applicant alleges that she was unfairly disciplined and dismissed for allegedly disobeying the house rule. The applicant alleges that as a temporary foreign female worker she was subjected to discriminatory rules with respect to housing guests that are not applied to Canadian-born employees.
