Resumen

The Appellant appealed the decision of the General Manager of the Ontario Health Insurance Plan (OHIP) to deny her coverage for failing to meet the definition of a resident according to s. 1.1(1)(b) of the Regulation under the Health Insurance Act. The Appellant had been granted a work permit under the Live-In Caregivers Programme (Programme) that expired on August 8, 2008. Prior to that date, the Appellant applied for Permanent Residence status to the Department of Citizenship and Immigration. With her work permit expired and her Permanent Residence application pending, the Appellant was informed that she would need to demonstrate that she had satisfied certain medical requirements to be eligible for OHIP in accordance with s. 1.1(1)(b)(4) of the Regulation. The Appellant appealed.

The Appellant has met the prescribed requirements to be an insured person under OHIP between September 1, 2008 and March 17, 2009.The appeal is granted.
