Abstract

Mr. Andro Rocha challenges a decision of a senior immigration officer [the Officer] refusing his
application for permanent residence from within Canada on humanitarian and compassionate [H&C]
grounds. Mr. Rocha had claimed that his establishment in Canada and hardship due to the lack of medical
care in the Philippines for HIV-positive persons and the associated discrimination directed at people living
with HIV were factors supporting his request for an H&C exemption pursuant to section 25 of the Immigration and Refugee Protection Act, SC 2001, c 27 [IRPA].
