- Abstract
The employer appeals the June 28, 2010 decision of Appeals Resolution Officer (ARO) D. McParland. The ARO allowed the worker entitlement for occupational asthma and corresponding Loss of Earnings (LOE) benefits and a Non-Economic Loss (NEL) assessment to determine the quantum of permanent impairment benefits. She also removed the costs of the NEL award from the employer’s cost statement.
The employer’s appeal is allowed.The worker does not have entitlement for occupational asthma.
